Case of Moses Lake school shooter back in court

SPOKANE, Wash. (AP) — The case of Moses Lake school shooter Barry Loukaitis is headed back to a courtroom.

A hearing is scheduled Friday in Ephrata to set a date for when Loukaitis will be re-sentenced for the 1996 killing of a teacher and two fellow students at Frontier Middle School.

Loukaitis was 14 when the shooting occurred on Feb. 2, 1996, and is serving a life sentence.

But KXLY reports that a recent U.S. Supreme Court decision held that children under the age of 16 can't be sentenced to life without the possibility of parole. That means Loukaitis must be re-sentenced in Grant County Superior Court.

Spokane County Prosecutor Larry Haskell is handling the case because of a conflict of interest in the Grant County prosecutor's office.
